Where was the statement made and what did it admit?
A judicial admission occurs before the court hearing the case concerning that fact and is conclusive against the admitting party alone. A pre-action message or statement in another case, if it acknowledges the fact, is an extrajudicial admission subject to the law’s rules of proof. An admission may be written or implied. Read “after returns are approved” together with the promise to pay. [1]
How do you establish attribution?
Signed or attributable correspondence carries the weight of a private writing unless the sender proves neither sending nor authorising it. Unofficial digital evidence from a channel specified in the contract is evidence against the parties unless rebutted. Article 58 puts the burden of challenging its authenticity on the challenger within its scope. Establishing the mailbox of origin is a separate question from the employee’s authority to bind the company. [1] If the email conditions payment on returns approval, establish approval and the residual sum before seeking a payment order. The money debt must be documented in writing, due and fixed in amount. [3]
What should accompany a disputed message?
Export the message with headers, attachments and later replies. Locate the statement the sender was viewing when referring to “the balance”. If compromise is alleged, compare transmission time to access logs and security alerts. Request separate confirmation identifying invoices and the admitted amount, and retain the original for comparison with screenshots. [1]
