Saudi commercial rent claimed before the premises were available

Reconcile a pre-handover rent invoice with site readiness, access and the tenant’s advance payment.

When was performance due?

The landlord must make the agreed use available. Rent is not due for elapsed time before delivery unless the tenant caused the delay. A landlord may withhold delivery pending advance rent. Read the advance-payment clause before assigning responsibility for the lost days. [1]

Trace the lost days

Compare site readiness, cleared funds and the access-card request. If the landlord says the premises were ready, ask for the key-release log. Separate delays in tenant fit-out from missing facilities the landlord promised to provide. Preserve the handover invitation and the tenant’s response showing when the keys became available in digital form for production. An extract carries the record’s evidentiary weight to the extent it matches that record. [3]

Reconcile the invoice

Build a timeline from contractual start to actual access showing the obstacle and likely cause in each period. Propose a correction for the disputed days, document undisputed payments and request a handover record describing the condition of the premises.

Temporal scope · 2026-10-30

The Law took effect 180 days after official publication. It generally reaches earlier events, except where a party invokes a conflicting pre-existing statutory rule or judicial principle applicable to the event, or a claim-barring period had already started. Separate registration and jurisdiction requirements still apply. [2]
