Assess the effect in this location
Ordinary unavoidable neighbourhood impacts are excluded, while impacts beyond the customary limit may be ordered removed. Relevant circumstances include local custom, property type, relative location and intended use. An operating licence does not itself preclude a neighbour’s claim for removal of excessive harm. [1]
Link measurements to the source
Log operating hours, wind direction and measurement location. Ask a specialist to compare readings when the equipment is running and stopped, and test nearby alternative sources. A single phone recording rarely establishes the baseline or frequency of disturbance. If the court appoints an expert, ask it to define the technical question in the order. The expert can measure noise or emissions at the affected property and identify the source and timing under ordinary operating conditions. [3]
Request a measurable remedy
If an exhaust outlet faces a bedroom window, propose testing redirection or filtration and repeating measurements at the same point. Include the operator’s response, previous mitigation attempts and the recorded impact that persists.
Temporal scope · 2026-10-30
The Law took effect 180 days after official publication. It generally reaches earlier events, except where a party invokes a conflicting pre-existing statutory rule or judicial principle applicable to the event, or a claim-barring period had already started. Separate registration and jurisdiction requirements still apply. [2]
