A Saudi neighbour built across the boundary. Is demolition inevitable?

Use survey and construction records to assess good faith, the occupied strip and possible compensation.

Check the footprint and good faith

Where an owner builds on their own land and in good faith crosses onto part of the adjoining land, the court may, if appropriate, compel transfer of the occupied strip for fair compensation. This is discretionary and fact-specific. A survey alone does not convey title. Required transfer formalities matter. [1]

Reconstruct what was known before construction

Obtain the authoritative boundary coordinates, foundation plan and dated setting-out record. Collect prior warnings and photographs of survey markers before excavation. An old fence may conflict with the plan, or the contractor may have continued after receiving a discrepancy notice. Register a final judgment transferring the encroached strip after first registration. If the claim requires changing the register, check the claim-notation and proof requirements. First confirm designation of the area and completion of first registration for this parcel. [3]

Compare feasible outcomes

Measure the occupied strip and its effect on setbacks and remaining use. Obtain a valuation and an engineering assessment of modifying the encroaching structure. A negotiated transfer should identify the coordinates, area and transaction costs instead of relying on an approximate fence description.

Temporal scope · 2026-10-30

The Law took effect 180 days after official publication. It generally reaches earlier events, except where a party invokes a conflicting pre-existing statutory rule or judicial principle applicable to the event, or a claim-barring period had already started. Separate registration and jurisdiction requirements still apply. [2]
